Our Terms and Conditions

PLEASE READ BOTH THE FOLLOWING TERMS AND CONDITIONS AS WELL AS THE RESPECTIVE TRAVEL SUPPLIERS (hereinafter "Suppliers") TERMS AND CONDITIONS CAREFULLY IN THEIR ENTIRETY. IT IS IMPORTANT TO UNDERSTAND BOTH THE TERMS AND CONDITIONS OF UNIVERSAL TRAVEL AND ITS SUPPLIERS AS ALL TERMS AND CONDITIONS APPLY TO YOUR TRAVEL ARRANGEMENTS. BY RESERVING A TRIP WITH UNIVERSAL TRAVEL AND ITS SUPPLIERS INDICATES YOUR ACCEPTANCE OF ALL TERMS AND CONDITIONS.

RESERVATION & PAYMENT:

To reserve a trip with Universal Travel and its Suppliers a deposit (which will vary depending on type of holiday and Suppliers terms) plus the applicable insurance premium is required at time of booking. The balance (which will vary depending on type of holiday and Suppliers terms) is due 45-90 days prior to departure. A booking made within 45-90 days (which will vary depending on type of holiday and Suppliers terms) of departure is payable in full at time of information. To confirm reservation, traveler or their representative must provide us with complete mandatory information of travelers, sign and return the relevant documentation not more than three days after receipt. Cheques, cash and major credit cards accepted (please see below terms for details). Clients must provide FULL LEGAL NAMES as they appear on passport or legal documentation at time of booking. Client must also be aware of any health and immigration requirements.

CHEQUES, CREDIT CARD & CASH BOOKINGS:

A client's authorization to use his/her credit card number for deposit, payments and/or final payments indicates their compliance with our booking terms and conditions as well as our Suppliers whether or not the client has actually signed the appropriate draft, cruise guest information form and/or payment authority form. Verbal authorization of their credit card confirms their reservation. Client's credit card will be charged for any and all expenses, fees and related charges pertaining to their holiday. Client's charges may be split between Universal Travel and its Suppliers and may appear as separate charges on their credit card statements by both Universal Travel and its Suppliers.

The client assumes all risks of loss if the client whose cheque or credit card was used in the purchase of travel related services for their holiday refuses and/or denies partial or full payment of any Universal Travel or Suppliers charges and agrees to indemnify Universal Travel against any and all liability, loss, costs, damages, attorney's fees and other expenses which Universal Travel may sustain or incur by reason of such denials. The client waives any and all rights to proceed directly against the client including but not limited to any legal or equitable remedy in Universal Travel's power whatsoever and agrees to be fully responsible for settlement by cash, certified cheque, or money order arising from such denials. The use of a client's credit card is a continuing guarantee and shall remain in force until the client notifies Universal Travel in writing to end such a guarantee.

Should a client's cheque not clear due to insufficient funds, Universal Travel has the authority to take legal action and not release any travel documentation to client. The client, subsequently, is also responsible for paying any and all NSF fees charged to Universal Travel by the bank. Also note that cheque payments will not be accepted after 14 business days prior to travel departure date.

INVOICES:

Invoices will be issued once the entire holiday has been finalized, paid in full and any additional fees (such as cancellation fees but not limited to) have been paid in full.

BOOKING CHARGES:

Changing your itinerary or name changes after reservations have been made will incur a minimum charge of $75.00 to a maximum charge of $400.00 per person each time a change is made in addition to any fees charged by our Suppliers.

DOCUMENTATION:

All forms and documentation must be signed and returned to Universal Travel prior to any documentation being released. Documents will be withheld if any outstanding monies are due. The entire booking must be paid inclusive of all charges and fees. Client must provide full legal names as they appear on passport at time of booking or they are responsible for fees incurred for changes. Also, any health and immigration requirements are the sole responsibility of the client. Single parents, guardians, etc. traveling with children must ensure they have proper documentation giving them custody over the child or children during their holiday and to be able to contract on their behalf as boarding may be denied at client’s own expense. Please ask a Universal Travel Consultant for full information as suppliers’ conditions may vary.

RATE ACCURACY:

Rates and schedules are subject to change for any reasons without notice. Rates are quoted in both Canadian or US funds for airline tickets, cruises, escorted tours, vacation packages, rail tickets, hotels, etc. at time of booking do not necessarily reflect brochure rates as additional fees may apply. Universal Travel is not responsible for any change or cancellation of any trip because of alteration issued by Travel suppliers.

TRAVEL INSURANCE:

Universal Travel strongly recommends that all travelers review and purchase your tip cancellation insurance and your health insurance to ensure you have coverage appropriate to meet your needs when confirming on a trip, in case of cancellation penalty, loss of property or liability of medical treatment during the trip. Please consult a Universal Travel Consultant for premium. If we do not receive payment for the insurance at time of your initial deposit and or at which time any penalties apply, it will be assumed that you have declined coverage. It is important that you advise a Universal Travel Consultant of any pre-existing conditions whatsoever with either the client, traveling companion or an immediate family member as failure to do so could result in your claim being denied. If a pre-existing condition exists it is the client's sole responsibility to contact the insurance company to inquire as to the eligibility of coverage.

LIMITATION OF LIABILITY:

Universal Travel and its Suppliers (herein called the Companies) act only as agents for the hotels, airlines, bus companies, railroads, cruise lines or owners/contractors providing accommodations, transportation or other services, and all coupons, exchange orders, contracts, and tickets issued by the Companies are issued subject to any and all tariffs, terms and conditions under which any accommodations, transportation or any other services whatsoever are provided by such hotels, airlines, bus companies, railroads, steamship lines or owners or contractors and, by the acceptance of such coupons, exchange orders, receipts, contracts, and tickets, the tour participants agree to the foregoing and also agree that neither the Companies nor any of their affiliates shall be or become liable or responsible for any loss injury or damage to the person. Property or otherwise in connection with any accommodations, transportation or other services or resulting directly or indirectly from Acts of God, dangers incident to the sea, fire, breakdown in machinery or equipment, acts of governments or other authorities, de jure or de facto, wars, weather declared or not hostilities, civil disturbances, strikes, riots, thefts, pilferage, epidemics, quarantines, medical or custom regulations, delays or cancellations of or changes in itineraries or schedules or from causes beyond the Companies control, or for any loss or damage resulting from improper or insufficient passports, visas, or other documents, and that neither the Companies nor any of its affiliated Companies shall be or become liable or responsible for any additional expense or liability sustained or incurred by the client participants as a result of any of the foregoing causes.

Airlines concerned are not to be held responsible for any act, omission, or event during the time the passengers are not on board their aircraft. Universal Travel is a retail travel agency licensed under the Newfoundland and Labrador Government, Registration no. 40783-98, G.S.T. no. 86902-7664.

If any action at law or in equity is necessary to enforce or interpret the terms and conditions of Universal Travel or its Suppliers, the prevailing party shall be entitled to reasonable legal fees, costs, and necessary disbursements in addition to any other relief to which the party may be entitled.

QUESTIONS, CONCERNS, COMPLAINTS:

Should you have any questions, concerns or complaints regarding the attached FEE STRUCTURE, TERMS AND CONDITIONS or require any additional information please contact one of our Universal Travel Consultants. All complaints must be made in writing to the attention of Heather Rice, Office Manager and accompanied by receipts, reports and any other documentation pertaining to their complaint and must be received by Universal Travel for investigation no later than 14 days after your return from your trip. No person other than a Universal Travel authorized representative may, by a document in writing, vary add or waive any term or condition in the terms and conditions or Universal Travel's fee structure, including any term or conditon set forth in the preceding provisions.
